China Work Permit and Residence Permit: Employer Guide

TL;DR

  • A Foreigner's Work Permit and a work-type residence permit are different approvals issued through different administrative systems. Most foreign employees need both before they can lawfully work and reside in China under the standard route.
  • The employer, role, work location, contract and actual work should tell the same story. A business or visitor visa, an overseas employment contract, or a pending application is not a substitute for permission to work in China.
  • Start with the job and sponsor, not the employee's travel date. Build time for document preparation, authenticity formalities, entry, local registration and two authority handoffs, then monitor renewals and changes.

The two approvals solve different problems

The work permit authorizes a foreign national to work for the approved sponsor, position and location. The work-type residence permit is the immigration document that permits qualifying residence in China for work. Holding only one does not automatically satisfy the other system.

For a standard new hire outside China, the process commonly moves from a Notification Letter of Foreigner's Work Permit to an appropriate entry visa, then to the Foreigner's Work Permit and a work-type residence permit after arrival. Exceptions and optimized local procedures exist, so the exact route should be confirmed for the applicant and city before travel is booked.

Who should sponsor the application?

The sponsoring employer should be the entity that genuinely employs and manages the individual in China. Its legal name, business license, job offer or contract, work address and authorized contact should align across the applications.

Before filing, confirm:

  • the China entity exists and can use the relevant government systems;
  • the proposed role fits the entity's real operations and registered business scope;
  • the work address and city are settled;
  • salary, contract term, duties and reporting line are approved;
  • the applicant's education, experience and professional background support the role; and
  • the employer has assigned one owner for work-permit, immigration, HR and travel handoffs.

Seven-step employer process

1. Check the applicant and role

Review the passport, nationality, age, qualifications, relevant experience, proposed duties, location and any prior China immigration record. China uses classifications and local acceptance criteria for foreign workers; do not assume that a title used by the overseas parent will be accepted unchanged.

2. Build the document pack

The exact list depends on the application, but employers commonly prepare:

  • passport identity page and compliant photograph;
  • employment contract or employment certificate stating the employer, position, location, term and remuneration;
  • education, professional-qualification and relevant work-experience evidence;
  • no-criminal-record documentation where required;
  • health-examination documentation in the accepted form;
  • the employer's business license, authorized-user and system information; and
  • supporting documents for accompanying family members, if included in the immigration plan.

Overseas public documents may require an apostille, consular legalization or another authenticity procedure accepted by the receiving authority. The correct route depends on the issuing country, document and current local instructions.

3. Obtain the pre-entry work approval

For the standard overseas route, the employer submits the work-permit application and obtains the notification used for the visa stage. Names, passport number, employer, position and location should be checked immediately; one inconsistency can carry into later applications.

4. Complete the correct entry step

The employee uses the approved documents to obtain the appropriate visa or follows another route expressly accepted for the case. A short-term business or visitor status should not be used to begin ordinary employment while the work application is pending.

5. Finish local arrival formalities

After arrival, complete the required accommodation registration and any accepted health-verification step promptly. The employee, hotel, landlord and employer should agree who supplies the registration evidence and by when.

6. Complete the work permit

Submit the post-entry materials and obtain the Foreigner's Work Permit through the local work-permit authority. Check that the approved employer, job, term and location match the employment documents and actual arrangement.

7. Apply for the work-type residence permit

Apply through the local public-security exit-entry administration with the work authorization and required immigration materials. Where the entry visa requires a residence-permit application after arrival, Chinese immigration regulations use a 30-day window from entry. Treat that as an outside legal deadline, not an internal target: appointments, missing documents or corrections can consume the available time.

When can the employee start working?

The conservative operating rule is to start ordinary work only when the approvals required for that arrangement are in place. Do not confuse attending a meeting or completing personal arrival tasks with beginning the employee's regular duties.

The contract start date, first working day, payroll record, tax withholding and permit records should be reconcilable. If commercial pressure requires an earlier contribution from the individual, obtain advice on a lawful alternative instead of relabeling employment as a visit.

Changes, renewals and departure

Work authorization is not a one-time onboarding file. A change of employer, position, work location, passport details or other material facts may require an amendment, transfer, new application or notification. The correct treatment depends on the change and local procedure.

Set calendar alerts well before expiry. Renewal usually requires current employer documents and continued eligibility, and a late discovery can affect travel, payroll and project continuity. When employment ends, coordinate permit cancellation, residence status, final payroll, tax, social-insurance and departure steps rather than letting each team act separately.

Common mistakes

  1. Booking a firm start date before confirming eligibility and document lead times.
  2. Treating a Z visa, business visa or submitted application as permission to work.
  3. Using the overseas parent in one document and the China employer in another.
  4. Changing the role or city after approval without checking whether the permit must be updated.
  5. Submitting inconsistent English names, passport numbers, dates or job titles.
  6. Starting overseas-document authentication too late.
  7. Waiting until the 30-day immigration window is nearly over before seeking an appointment.
  8. Forgetting accommodation registration after a move, where updated registration is required.
  9. Tracking the work permit but not the residence permit, passport or dependent documents.
  10. Ending employment without a coordinated cancellation and status plan.

Frequently asked questions

Is a work visa the same as a work permit?

No. A visa supports entry for the stated purpose; the work permit authorizes the approved employment, and the work-type residence permit supports residence after entry under the standard long-term route. The applicable sequence must be checked for the case.

Can an employee work while the application is pending?

A pending application does not itself grant work authorization. Confirm the lawful start point with the local authorities and do not rely on an ordinary business or visitor status for regular employment.

Can the employee change employers without a new process?

Usually not as a purely private contract change. The existing authorization is tied to approved facts, and a transfer, cancellation plus new application, or another local process may be required before the employee works for the new sponsor.

Does a dependent residence permit allow the spouse to work?

Family residence status does not automatically authorize employment. A spouse who takes a job normally needs the work authorization and immigration status applicable to that employment.
